Online Banking Agreement

By using the Bridgeport Police Federal Credit Union's Online Banking service or permitting someone else to use it, each of you, jointly and severally, agree to the terms and conditions set forth in this Agreement on behalf of yourself and any person or entity authorized to or otherwise permitted to act on behalf of yourself.  The terms and conditions of this Agreement may change at any time without prior notification so please review this Agreement regularly.

In this Agreement "Credit Union", "we", "us", and "our" mean Bridgeport Police Federal Credit Union; "you" and "your" mean each person who uses the Bridgeport Police Federal Credit Union's Online Banking service; "Online Banking" means the service that allows you to view and perform transactions on your Credit Union account(s) over the internet; "Online Banking credentials" means your Online Banking user ID, password, security questions and security image with phrase; "account" means your account(s) with the Credit Union; "transaction" means any payment, transfer, stop payment request or other transaction we allow to be done through Online Banking. 

General Information:
In addition to this Online Banking Agreement, your accounts will continue to be governed by their individual account agreements and by all applicable state and federal laws and regulations.  We reserve the right to refuse or reverse any transaction that would draw upon insufficient or unavailable funds, funds that are set aside for automatic loan payments or transactions that would lower an account below a required balance.  For security reasons, we may further limit the frequency and/or dollar amount of transactions from your account.

Types of Transactions Allowed:
In addition to accessing balance and transaction information on your account(s) with us, you can transfer funds between your accounts (including transferring a payment to a loan), request a stop payment on a personal check, request a check be mailed to you at your address on file and transfer funds between your account and another member's account with us provided we've received authorization from that member to link their account and the link has been set up in our system.  Accounts may have transfer limitations due to state and federal laws and regulations.

Electronic Communications and Access:
You are responsible for the installation, maintenance and operation of any software and hardware required to access our Online Banking service.  We will not be responsible for any errors or failures involving telephone service, internet service, software installation or your computer.  Our Online Banking service is normally accessible 24 hours a day, 7 days a week with the exception of short periods for processing, maintenance, upgrades and circumstances beyond our control.

If you wish to have your account removed from Online Banking, please contact the Credit Union using the address or phone number above.  The Credit Union reserves the right to terminate access to our Online Banking service, in whole or in part, at any time for any reason without prior notification.  Reasons for terminating access include, but are not limited to, if you do not comply with the agreement(s) governing your Credit Union account(s), if your account(s) are not maintained in good standing or if you've violated any portion of this Agreement.  Termination of access to Online Banking, whether precipitated by you or the Credit Union, in no way affects your liability or obligation under this Agreement or any other agreement you have with us.

Identification (ID), Password and Security Features:
We will issue you a user identification and password to access our Online Banking service.  You agree to change the password upon accessing Online Banking for the first time and to change it regularly thereafter.  As an added security feature, once you're in Online Banking for the first time, you'll be required to set up security questions and choose an image and phrase.  You agree to answer the security questions and to look at the image and phrase each time you use Online Banking.  (The image and phrase help ensure that the site you're on is our legitimate site and not a take-over site.)

Security and Your Liability for Unauthorized Access:
You agree not to disclose your Online Banking credentials or to otherwise make them available to anyone who is not a joint owner on your accounts with us.  This information should be kept in a safe place where others can't obtain it.  If you suspect this information has been compromised, you agree to immediately change your Online Banking credentials or to contact the Credit Union to make these changes.  If you remove or change a joint owner(s) on your account, you agree to change your Online Banking credentials or to contact the Credit Union to make these changes.  When removing/changing a joint owner(s), you must specifically tell us to terminate their Online Banking access to your account.  Also, if you've provided authorization in the past for us to link your account to another member's account so they can view your account or make transactions on the account under their Online Banking credentials, you must contact us to revoke that authorization.

We are entitled to act on any instruction received under your Credit Union Online Banking user ID and password.  If you do disclose any of your Online Banking credentials to others, you are authorizing them to make Online Banking transactions and you hereby agree that you are responsible for all such transactions conducted by them even if the person exceeds your authority.  In the event we incur losses or expenses resulting from such use, you hereby agree you will immediately reimburse us upon demand.

You agree to check your account statements for unauthorized use when you receive them.  You agree to notify the Credit Union immediately if you suspect that unauthorized access or transactions have occurred on your account(s).  If your failure to keep your password and/or other access information secured or to contact us immediately causes the Credit Union a loss, we reserve the right to terminate your access to our Online Banking service.

If unauthorized Online Banking transactions have occurred on your account(s), you will lose no more than $50 if you notify us within two (2) business days after you learn of the loss or theft.  If you do NOT notify us within two (2) business days after you learn of the loss or theft and we could have stopped someone from taking money without your permission had you told us, you could be responsible for the entire loss or theft up to $500.  If you fail to notify us within sixty (60) days after your account statement was sent to you or made available to you through Online Banking or otherwise, any preventable losses occurring after the sixty (60) day period may not be refundable.  Statements will be mailed to the address we have on file; E-Statements are normally available on Online Banking on the 1st business day of each month.

Joint and Several Liability:
If two or more accounts are linked together, the owners of those accounts shall be jointly and severally liable for all losses arising out of any one or more of the linked accounts.

Our Liability:
Our obligations hereunder are limited to receiving and executing, as applicable, your transactions in accordance with the terms of this Agreement.  If we improperly effect or fail to effect a directed transaction in accordance with the terms of an accepted instruction, we shall reimburse amounts improperly debited from your accounts only if and to the extent such reimbursement is required under applicable law, with such interest and incidental expenses as is required by applicable law, within a commercially reasonable time after you notify us of any such error, provided we have verification of the occurrence of such error.  We shall have no liability for erroneous instructions given by you or received under your Online Banking user ID and password.  We shall have no liability for any loss or expense which you may incur unless such loss or expense is attributable to the willful misconduct of Bridgeport Police Federal Credit Union or our agents including liability for direct or consequential damages.  In no event shall we be liable for any indirect, special, consequential or punitive damages (even if we have been advised of the possibility of such damages), such liability being hereby specifically waived by you in consideration of this Agreement.

You have sixty (60) days after any statement is mailed to you, made available to you through Online Banking or otherwise given to you, informing you of instructions received and acted upon by us, to examine such statement and notify us in writing of any error with respect thereto.  Failure to notify us within such period shall be deemed unreasonable and you acknowledge that the actions reflected on such statement shall be deemed to be properly executed if you have not provided written notice of error within sixty (60) days as stated above.

Force Majeure:
You agree that we are excused from the performance of our obligations under this Agreement to the extent that we are prevented or delayed from performing our obligations due to causes beyond our control including, but not limited to, those caused by acts of God, severe weather, acts or omission of another party, acts or orders of any government or regulatory body (including civil or military), fires, epidemics, riots, sabotage, strike or labor disputes, loss of power or telecommunications equipment or line failures (each a "Force Majeure Event").  Our responsibilities under this Agreement will resume as soon as reasonably possible after the Force Majeure Event has passed or expired.

Waiver of Rights:
We may waive any of our rights under this Agreement without waiving any other rights we have.  If we do waive a right, that does not mean we will always waive it.

No delay or omission on the part of the Credit Union in exercising any rights will act as a waiver of such rights.  Except for the extent that we are liable under the terms of this Agreement, you agree to indemnify and hold the Credit Union, its' employees, volunteers and agents harmless from all loss, liability, claims, demands, judgments and expenses arising out of or in any way connected with an account or the performance of our Online Banking service, except to the extent such indemnification is not permitted by law.  You further agree that in the event either party brings legal action to enforce this Agreement, you will be liable to us for any liability, loss or expense, including reasonable attorney's fees, if we win and you hereby authorize us to deduct such amount from your account(s) at the Credit Union without prior notification.

If any provision of this Agreement is held invalid, illegal, void or unenforceable by any rule, regulation, law, administrative order or judicial decision, all other provisions of the Agreement shall remain in full force.

Your Representations and Warranties:
You hereby represent and warrant that the following statement is true, complete and accurate and you agree to notify us immediately if the following statement should no longer be true, complete and/or accurate:

  You are the owner or joint owner of the account that you are hereby enrolling in Online Banking or accessing through Online Banking.

Funds Availability Schedule 

A.  Check clearing:  When you cash or deposit a check, it must be sent to the institution on which it's drawn for payment.  That institution will either pay the check or refuse payment and return it to us.  This process is called "check clearing".  During this check clearing period, we may or may not allow you to withdraw or use the funds to pay checks or other items you have authorized.  The Credit Union will charge an overdraft fee for each transaction that overdraws the available balance in your account except for ATM and everyday debit card transactions if you have not opted-in to our Overdraft Program.

B. Determining the availability of a deposit:  The length of delay in funds availability is counted in business days from the day of your deposit. For purposes of this Schedule, every day is a business day except Saturdays, Sundays, and federal holidays (even if our offices are open on those days).  

C.  Same Day Availability (no hold):  If you make a deposit in person to one of our employees, funds from the following deposits are available on the business day your deposit is made: 

  • Cash
  • Government checks payable to you (includes US Treasury checks, US Postal money orders, and Federal Reserve Bank or Federal Home Loan Bank checks)  
  • State and local government checks payable to you (includes City payroll checks)
  • Checks drawn on the Bridgeport Police FCU (on-us checks)
  • Cashier's, certified, and teller's checks payable to you 
  • Electronic payments, which include wire transfers and ACH credits, are available the business day we receive the funds
  • Computer-generated, machine-signed payroll checks if you have a checking account with us   

If you do not make your deposit in person with one of our employees (ex. if you deposit in our night drop), funds from these deposits will be available on the first business day after the day we receive your deposit.  This does not apply to electronic payments.

D.  All other check deposits:  The first $200 is available on the first business day after the day of deposit; the remaining funds are available on the second business day after the day of deposit.

E.  Longer Delays May Apply:  Funds you deposit by check may be delayed for a longer period under the following circumstances:

  • We believe a check you deposit will not be paid.
  • You deposit checks totaling more than $5,000 on any one day.
  • You redeposit a returned check.  
  • You have overdrawn your account repeatedly in the last six months.
  • There is an emergency such as an equipment failure or the suspension of payments by another financial institution. 

We will notify you if we delay your ability to withdraw funds for any of these reasons and we'll let you know when the funds will be available unless, at the time of notice, we are unable to establish a timeframe due to an emergency situation.  Funds will generally be available no later than the sixth business day after the day of deposit.

F.  Special Rules for New Members:  The following rules apply during the first 30 days of new membership:

  • Cash and funds from electronic payments will be available on the business day we receive the funds.
  • The first $5,000 from a deposit of any check type listed in section C of this Schedule will be available on the business day of your deposit providing the items are made payable to you and are deposited in person to one of our employees.  If you do not deposit the items in person to one of our employees, the first $5,000 will not be available until the first business day after the day of your deposit.  The excess over $5,000 will be available on the sixth business day after the day of your deposit.
  • Funds from all other check deposits will be available on the sixth business day after the day of your deposit.

G.  Holding Alternate Funds Already on Deposit:  We may make funds from a check immediately available if you have funds to cover the check already on deposit with us.  In this event, the funds on deposit will be held for the time period that corresponds with the type of check deposited.
