Online Banking Agreement

Please read the following Online Banking Agreement.

By using our Credit Union's Online Banking service each of you, jointly and severally, agree to the terms and conditions set forth in this Agreement.  The terms and conditions of this Agreement can change at any time without prior notification.

You are responsible for the installation, maintenance and operation of any software and hardware required to access our Online Banking service. We will not be responsible for any errors or failures involving telephone service, Internet service, software installation or your computer.  The Online Banking service is normally accessible 24 hours a day, 7 days a week with the exception of short periods for processing, maintenance, upgrades, or circumstances beyond our control.

Your accounts will continue to be governed by their original agreements and by all applicable state and federal laws and regulations.  We reserve the right to refuse or reverse any transaction that would draw upon insufficient or unavailable funds, funds that are set aside for automatic loan payments, or transactions that would lower an account below a required balance.  For security reasons, we may further limit the frequency or dollar amount of transactions from your account.

Security and Liability for Unauthorized Access
Access to all accounts requires a Personal Identification Number (PIN).  We recommend you change your PIN when using the Online Banking service for the first time and regularly thereafter.  You agree not to disclose your PIN or otherwise make it available to others.  We have the right to act on instructions received under your PIN.  If you disclose your PIN to others, you are responsible for all transactions conducted by them.  You agree to check your account statements for unauthorized use when you receive them.  You agree to notify the Credit Union immediately if you suspect unauthorized access or transactions on your account(s).  If your failure to keep your PIN secured or to contact us immediately causes the Credit Union a loss, we reserve the right to terminate your access to our Online Banking service.  If you notify us within two business days, you will lose no more than $50 if someone accesses your accounts without your permission.  If you do not notify us within 2 business days and we can prove that we could have prevented someone from accessing your account, you could lose up to $500.  If you fail to notify us within 60 days after your account statement was mailed, any preventable losses occurring after the 60 day period may not be refundable.

Termination
If you wish to have your account removed from our Online Banking service, please contact the Credit Union.  Termination of access to our Online Banking service, whether precipitated by you or the Credit Union, in no way affects your liability or obligation under this Agreement.

Legalities
No delay or omission on the part of the Credit Union in exercising any rights will act as a waiver of such rights.  Except for the extent that we are liable under terms of this Agreement or any other agreement that governs your account(s), you agree to indemnify and hold the Credit Union, its employees, volunteers, and agents harmless from all loss, liability, claims, demands, judgements, and expenses arising out of or in any way connected with an account or the performance of our Online Banking service, except to the extent such indemnification is not permitted by law.  You further agree that in the event either party brings legal action to enforce this Agreement, you will be liable to us for any liability, loss or expense, including reasonable attorneys fees, if we win and you authorize us to deduct such amount from your account(s) with the Credit Union without prior notification.

A.  Check clearing:  When you cash or deposit a check, it must be sent to the institution on which it's drawn for payment.  That institution will either pay the check or refuse payment and return it to us.  This process is called "check clearing".  During this check clearing period, we may or may not allow you to withdraw or use the funds to pay checks or other items you have authorized.  The Credit Union will charge an overdraft fee for each transaction that overdraws the available balance in your account except for ATM and everyday debit card transactions if you have not opted-in to our Overdraft Program.

B. Determining the availability of a deposit:  The length of delay in funds availability is counted in business days from the day of your deposit. For purposes of this Schedule, every day is a business day except Saturdays, Sundays, and federal holidays (even if our offices are open on those days).
