By using our Credit Union's Online Banking service each of you, jointly and severally, agree to the terms and conditions set forth in this Agreement. The terms and conditions of this Agreement can change at any time without prior notification.
Definitions
In this Agreement and Disclosure "Credit Union", "we", "us" and "our" mean Bridgeport Police Federal Credit Union; "you" and "your" mean each person who uses the Bridgeport Police Federal Credit Union Online Banking service; "Online Banking" means the service we provide that allows you to view and perform transactions on your Credit Union accounts over the interent.
General Information
In addition to this Online Banking Agreement and Disclosure, your accounts will continue to be goverened by their original agreements and by all applicable state and federal laws and regulations. We reserve the right to refuse or reverse any transaction that would draw upon insufficient or unavailable funds, funds that are set aside for automatic loan payments or transactions that would lower an account below a required balance. For security reasons, we may further limit the frequency and/or dollar amount of transactions from your account.
Identification (ID) and Password
We will issue you a user ID and password to access our Online Banking service. You agree to change the password upon accessing the Online Banking service for the first time. As an added security feature, once you're in Online Banking for the first time, you will be required to set up access questions that you'll have to answer each time you enter the system and also choose a picture and saying that you'll have to mark each time you enter the system.
We strongly suggest that you do not allow Online Banking access to your account(s) to anyone who is not an authorized signer on your account(s) as listed on the account application(s) and/or signature card(s).
Security and Liability for Unauthorized Access
We recommend you change your password regularly. You agree not to disclose your password or other access information or to otherwise make it available to others. This information should be kept in a safe place where others can't obtain it. You also agree to immediately change your password and other access information or to contact the Credit Union to make these changes if you suspect this information has been compromised. We are entitled to act on any instruction received under your Credit Union Online Banking ID and password. If you disclose your password to others, you are authorizing them to make Online Banking transactions and are therefore responsible for all transactions conducted by them even if the person exceeds your authority. You agree to check your account statements for unauthorized use when you receive them. You agree to notify the Credit Union immediately if you suspect unauthorized access or transactions have occurred on your account(s). If your failure to keep your password and/or other access information secured or to contact us immediately causes the Credit Union a loss, we reserve the right to terminate your access to our Online Banking service. If unauthorized Online Banking transactions have occurred on your account(s), you will lose no more than $50 if you notify us within two business days after you learn of the loss or theft. If you do NOT notify us within two business days after you learn of the loss or theft and we could have stopped someone from taking money without your permission had you told us, you could be responsible for the entire loss or theft up to $500. If you fail to notify us within 60 days after your account statement was sent to you, any preventable losses occurring after the 60 day period may not be refundable.
Our Liability for Failure to Complete Payments or Transactions
If we do not complete a payment or transfer on time or in the correct amount according to our Agreement with you, we will only be liable to you to complete such payment or transfer. Under no circumstances will the Credit Union be liable for damages that you may suffer, including consequential damages, due to our failure to complete a payment or transfer.
Electronic Communications and Access
You are responsible for the installation, maintenance and operation of any software and hardware required to access our Online Banking service. We will not be responsible for any errors or failures involving telephone service, internet service, software installation or your computer. The Online Banking service is normally accessible 24 hours a day, 7 days a week with the exception of short periods for processing, maintenance, upgrades, or circumstances beyond our control.
Termination
If you wish to have your account removed from our Online Banking service, please contact the Credit Union. The Credit Union reserves the right to terminate access to our Online Banking service in whole or in part at any time if you do not comply with the agreement(s) governing your Credit Union account(s), if your account(s) are not maintained in good standing or if you've violated any portion of this Agreement. Termination of access to our Online Banking service, whether precipitated by you or the Credit Union, in no way affects your liability or obligation under this Agreement.
Legalities
No delay or omission on the part of the Credit Union in exercising any rights will act as a waiver of such rights. Except for the extent that we are liable under terms of this Agreement or any other agreement(s) that governs your account(s), you agree to indemnify and hold the Credit Union, its employees, volunteers, and agents harmless from all loss, liability, claims, demands, judgements, and expenses arising out of or in any way connected with an account or the performance of our Online Banking system, except to the extent such indemnification is not permitted by law. You further agree that in the event either party brings legal action to enforce this Agreement, you will be liable to us for any liability, loss or expense, including reasonable attorneys fees, if we win and you authorize us to deduct such amount from your account(s) with the Credit Union without prior notification.
